Delaware Direct to Consumer Shipping Update
Effective August 15, 2026, Delaware implemented a new law allowing qualified wineries to ship wine directly to consumers in the state under a new licensing framework.
Wineshipping is aware of recent industry reports raising questions about carrier availability under the new requirements.
Wineshipping is continuing to ship compliant Delaware Direct to Consumer (DTC) orders through UPS. UPS has confirmed directly to Wineshipping that it intends to continue accepting DTC wine shipments to Delaware and is working to update its published guidance to reflect the new law.
What Wineries Need to Know
Under Delaware’s new requirements, wineries shipping DTC to Delaware must:
Obtain a Delaware Wine Direct Shipper license.
Ship through a common carrier licensed by Delaware.
Collect and pay applicable Delaware wine taxes and meet required reporting requirements.
Follow Delaware’s labeling and adult-signature requirements.
Limit shipments to no more than three 9-liter cases per household annually and 1,800 9-liter cases statewide per winery annually.
There are also restrictions for wineries already represented in Delaware by a licensed importer/wholesaler.
What Wineshipping is Doing
We are continuing to work directly with UPS and monitor implementation of the new requirements. Based on the guidance UPS has provided to us, Wineshipping will continue shipping eligible Delaware DTC orders through UPS at this time.
